Article 1. General

We are committed to respecting your privacy when using the orthobello.be website and your rights to protection and control of personal data. For this reason, the purpose of this charter is to inform you in a complete and transparent manner about the nature of the personal data we collect and the use we make of this data.

The processing of personal data relating to this site is subject to Belgian law. In particular, they are subject to the Law of December 8, 1992 on the protection of privacy with regard to the processing of personal data and, since May 25, 2018, to European Regulation 2016/679 of April 27 on the protection of individuals with regard to the processing of personal data and on the free movement of such data ("GDPR").

Article 2. Collected data

No personal data is automatically collected by the site itself. The only data we process is that which you voluntarily communicate to us, for example by choosing a language, filling in a contact or request form on the site, communicating with us by e-mail, etc. Within this framework, the personal data that we may collect and process depending on your use of the site are as follows:

General personal information: title, surname, first name, gender, date and place of birth, telephone number, postal address, e-mail address and IP address.

Your language preferences.

Your location data.

Data about your activities on our website.

Wherever possible, we also record the date on which personal data was communicated or on which certain adjustments were made to such data.

The personal data recorded may also contain other information, such as your product or service preferences, which you have communicated to us in the course of our business relations.

Any other data collected automatically is done so only by statistical tools, such as Google Analytics, and concerns only the date and time, your TCP/IP address, the brand and latest version of your browser, and the web pages consulted, but remains completely anonymous.

Finally, we may receive information about you through social media, for example, when you interact with us on social media. We protect all data obtained from third parties in accordance with the practices described in this Privacy Policy. We also apply any additional restrictions imposed by the source of the data.

Article 3. Use of data

The personal data we collect are used for the following purposes:

to enable you to use the various features of the site, to provide you with the services you request, to record and respond to your requests or queries; and for any other purpose necessary for the performance of the contract you enter into with us by using our website and services;

send you information about our products and services, in particular by e-mail, provided you have given your consent when registering;

ensure the site's computer security, prevent and combat any fraud or abuse;

to compile global statistics in order to improve our site and our services. However, we will only use your personal data in an aggregated form that does not allow you to be directly identified.

Article 4. Use of cookies

Article 5. Data security

We take the security and confidentiality of your personal data very seriously.

We make every effort to take appropriate technical and organizational measures to prevent any accidental or unlawful violation of your personal data, including destruction, loss, unauthorized disclosure, misuse, alteration or unauthorized access to data collected on our site, and thus ensure appropriate security and protect your personal data at all times.

In the event of a proven violation of your personal data, you will be informed as soon as possible. 

Article 6. Transfer of data to third parties

Your data will only be used internally, and will therefore never be passed on or sold to other natural or legal persons, whether or not they are linked to our company. In addition, all our employees and independent service providers who have access to your data are bound by a strict duty of confidentiality.

Your personal data may be communicated to subcontractors (e.g. IT service providers, clouds, etc.), but only in the context of services performed on our behalf on the basis of our instructions and in accordance with this declaration. In the event that a third party is entrusted with the processing, on our behalf, of data collected, a data processing agreement will be concluded by us with the third party in question in order to guarantee the same level of protection and confidentiality of the personal data collected. In all cases, we remain responsible for the processing of such data.

As for the storage of your personal data, we guarantee to only select service providers that comply with the provisions of the GDPR.

Where appropriate, we may transmit your personal data when required to do so by judicial or administrative authorities, but always in compliance with applicable legislation.

Article 7. Data retention period

We undertake not to keep your personal data beyond the period deemed necessary to achieve the purposes mentioned in this charter.

Article 8. Your rights

In accordance with applicable legislation, you have the right to access, rectify, erase, restrict processing, object to processing and the right to portability of your personal data at any time, as well as the right not to be subject to a decision based exclusively on automated processing, including profiling.

Orthobello SCRL will notify each recipient to whom personal data has been communicated of any rectification or erasure of personal data or any restriction on the processing thereof, unless such communication proves impossible or would require disproportionate effort.

You may also withdraw your consent to the uses you have previously authorized at any time. The revocation of your consent for any of these uses of your personal data will apply only for the future, without affecting the processing already carried out.

The owner of the personal data acknowledges having been fairly and fully informed of the processing of said data by Orthobello SCRL. In addition to this right to information, the holder has the following rights:

The data subject's right of access to his or her data. In other words, the right to obtain confirmation from the data controller as to whether or not data is being processed, and access to said data.

Right to rectification of inaccurate information and completion of incomplete data.

The right to have one's data erased when it is no longer necessary for the purposes for which it was collected, if the person withdraws consent (and there is no other basis (legal obligation) for processing), or if the person exercises the right to object to processing.

Right to restriction: when the data controller no longer needs the data, but it is still necessary. When such a restriction, which is in principle temporary, is put in place, the data may only be processed, except for storage purposes, with the consent of the data subject or for specific reasons.

Right to portability: the data subject has the right to obtain the data he or she has provided in a structured, commonly used and machine-readable format, and has the right to transmit this data to another controller without the original controller being able to object. The data subject may request that his or her data be transmitted directly from one controller to another.

Right to object: data subjects have the right to object to the processing of their data, enabling them to ask the data controller to stop processing their data, and in any case to object to canvassing.

All requests must be accompanied by proof of identity.

You also have the right to appeal to the Data Protection Authority, without prejudice to any other effective legal remedy.

Article 9. Update

We reserve the right to modify the present charter in order to take into account any legal, jurisprudential or technical evolution. Only the latest version will prevail.
